Defense Motion to Dismiss & Judge Collins case associations

Attorney Azhari files a Motion to Dismiss on behalf of Richard Wanke. It focused on how gunshot residue information in the State’s presentation to the Grand Jury (made by prosecutor James Brun) could have been misinterpreted by the jurors as indicating that gunshot residue incriminating Richard Wanke in the Clark murder was found by police on items sent for forensic lab testing. The defense maintains that this misleading presentation of evidence the State had could have caused the Grand Jury to indict Richard when they might not otherwise have done so.

Judge Collins also indicated that upon review of the State’s list of potential witnesses in the case, she has at least one close connection to Kris Carpenter which could potentially cause her to be conflicted in presiding over Richard’s case.
