This appearance is the first indication that Clark has some understanding (from repeated input from Richard) that Richard wants a full trial and defense; that Richard has an alibi defense to present and that he does not want to just present medical experts to testify that he is insane. Richard has also pointed out to Clark and finally convinced Clark that there is evidence in his case that should first be challenged in a suppression hearing about whether or not it should be admitted at trial.
A suppression hearing about whether evidence should be admitted at trial is usually done before trial is set. The judge and the attorneys recognize by Clark’s indication that a suppression hearing will be required, and that this case is not anywhere close to being ready for trial. So, here, the court takes the case completely off the track for trial.
